1. About These Terms

These Terms of Service (“Terms”) govern your use of the Mikato website, chatbot, and concierge services (together, the “Service”).

The Service is operated by Botterfly AI Teknoloji Limited Şirketi (“we,” “us,” or “our”), trading as Mikato, a company registered in Istanbul, Turkey.

By using the Service, you agree to these Terms. If you do not agree, please do not use the Service. You must be at least 18 years of age (or the age of majority in your country) to use the Service.

2. What Mikato Does

Mikato provides two things:

  • Free AI-powered guidance - A conversational guide that answers questions about living in Turkey: residence permits, address registration, work permits, entry bans, banking, document requirements, and more. When you use the Mikato chatbot, you are interacting with an artificial intelligence system, not a human.
  • Paid concierge services - When you need hands-on help, our concierge team (real people) handles the details for you. This includes gathering documents, coordinating translations, and preparing you for your appointments.

3. Important: Not Legal Advice

Mikato is not a law firm and does not provide legal advice. The information provided through our chatbot and website is general guidance based on publicly available information about Turkish immigration and administrative processes.

This guidance is not a substitute for professional legal counsel. Immigration rules change frequently, and your specific situation may have details that general guidance cannot cover. For legal matters, we recommend consulting a licensed Turkish attorney (avukat).

Our concierge services are administrative in nature - we help with paperwork, appointments, and logistics. We do not represent you in legal proceedings, provide legal opinions, or act as your attorney.

4. AI Disclosure and Limitations

The Mikato chatbot is an AI system. In accordance with the EU AI Act (Article 50), we inform you that when you use our chatbot, you are interacting with artificial intelligence - not a human advisor.

While we work to keep information accurate and current, AI responses may contain errors or outdated information. You should:

  • Verify important information with official sources before acting on it
  • Not rely solely on Mikato for urgent or high-stakes decisions
  • Understand that AI responses are generated based on patterns in data and may not account for every individual circumstance

The chatbot uses automated processing to generate personalized responses based on your questions. No legally binding decisions are made by the AI. You can request human assistance at any time by asking to speak with our concierge team.

Mikato is not designed for emergency situations. If you are in immediate danger or face an urgent legal crisis, contact local emergency services or a licensed attorney.

5. Your Responsibilities

When using the Service, you agree to:

  • Provide accurate information about your situation so we can give you relevant guidance
  • Not use the Service for any unlawful purpose
  • Not attempt to reverse-engineer, copy, or misuse our AI system
  • Not submit content that is harmful, abusive, or violates the rights of others
  • Not use automated systems (bots, scrapers) to access the Service

6. Concierge Services and Cancellation

Paid concierge services are a separate engagement between you and Mikato. When you decide to use our concierge:

  • Pricing and scope will be discussed and agreed upon before any work begins
  • You will receive a clear description of what is included
  • Payment terms will be communicated before you commit
  • You can ask questions at any time about the status of your case

Right of withdrawal

Under Turkish Consumer Protection Law (No. 6502) and the Distance Contracts Regulation, you have the right to cancel a concierge service within 14 days of agreeing to the service, without giving any reason.

To cancel, send us an email at hello@mikato.co clearly stating your wish to withdraw. If you have already made a payment, we will refund you within 14 days of receiving your cancellation notice.

Exception: If the concierge service has been fully completed with your prior express consent before the 14-day period ends, the right of withdrawal no longer applies. We will always inform you of this before beginning work.

7. Privacy and Data

We take your privacy seriously. Our collection and use of personal data is described in our Privacy Policy and Cookie Policy, which form part of these Terms. By using the Service, you acknowledge that you have read and understood these policies.

Chat conversations are stored to provide you with continuity of service. You can request deletion of your data at any time by contacting us at hello@mikato.co.

8. Intellectual Property

The Mikato name, logo, website design, and AI system are our intellectual property. You may not copy, modify, or distribute any part of the Service without our written permission.

Content you share with us (such as documents for concierge review) remains your property. We only use it to provide the Service to you.

9. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided “as is” without warranties of any kind
  • We are not liable for any decisions you make based on guidance from Mikato
  • We are not liable for any indirect, incidental, or consequential damages
  • For free chatbot guidance, our liability is limited to re-performing the service
  • For paid concierge services, our total liability is limited to the fees you paid for the specific service that gave rise to the claim

Nothing in these Terms limits liability for fraud, gross negligence, willful misconduct, or any liability that cannot be excluded under Turkish law or the applicable consumer protection laws of your country.

10. Force Majeure

We are not liable for delays or failures in performing concierge services caused by events beyond our reasonable control. This includes but is not limited to: changes in Turkish government procedures, office closures, appointment system outages, regulatory changes, natural disasters, or public health emergencies.

We will notify you as soon as possible if such an event affects your service and work with you to find an alternative solution.

11. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the “Last updated” date at the top of this page.

For significant changes - particularly those affecting your rights, our data practices, or concierge pricing - we will notify you by email (if we have your address) or by a prominent notice on our website. Material changes take effect 30 days after notice. If you do not agree with the updated Terms, you should stop using the Service.

12. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Turkey.

For claims related to paid concierge services, consumers in Turkey must first apply to the relevant Consumer Arbitration Committee (Tüketici Hakem Heyeti) for disputes below the applicable monetary threshold. For disputes above the threshold or for other claims, the courts of Istanbul, Turkey have jurisdiction.

If you are an EU/EEA resident, you also retain the right to bring a claim in the courts of your country of residence, where applicable under EU consumer protection rules.
